2. Definitions
- Application means the Avira mobile application.
- Website means the Avira website.
- Service means the Website, Application, AI companion experiences, content, features, subscriptions, and related services offered by Avira.
- User, you, or your means a person who accesses or uses the Service.
- Content includes text, messages, images, audio, video, characters, graphics, software, and other materials available through or submitted to the Service.
3. Eligibility
You must be at least 18 years old and legally capable of entering into these Terms to use Avira. By using the Service, you confirm that you meet these requirements.
4. About Avira
Avira is an AI companion service offering virtual characters, generated conversations, and related personalized entertainment features. Avira's companions are fictional, automated systems and are not real people. The Service is intended for personal entertainment and is not a substitute for human relationships or professional medical, mental-health, legal, financial, or emergency services.
5. Accounts and Security
Some features may require an account or identity verification. You agree to provide accurate information, maintain the security of your credentials, and promptly notify us if you suspect unauthorized access.
You are responsible for activity conducted through your account. You may not sell, transfer, share, or create accounts through unauthorized automated methods.
6. AI-Generated Content
Responses and other material produced by Avira are generated automatically. They may be inaccurate, incomplete, unexpected, or unsuitable for a particular purpose. You are responsible for evaluating generated content and for decisions you make based on it.
Do not rely on Avira for professional advice or emergency assistance. If you or another person may be in danger, contact local emergency services or an appropriate qualified professional.
We may use automated systems and human review where permitted to operate the Service, enforce these Terms, investigate abuse, improve safety, and meet legal obligations.
7. Subscriptions, Trials, and Payments
Avira may offer paid subscriptions, trials, credits, or other digital purchases. The applicable price, trial period, billing cycle, included features, taxes, and renewal terms will be shown before purchase.
- Subscriptions may renew automatically unless cancelled before the renewal date.
- Payment may be processed by an app store or third-party payment provider.
- We do not directly store full card numbers, UPI PINs, banking passwords, or similar payment credentials.
- Prices and available plans may change, but a change will not apply retroactively except as disclosed and permitted by law.
8. Cancellation and Refunds
Cancellation and refund requests are governed by our Cancellation Policy and by the rules of the app store or payment provider used for the purchase.
Deleting the Application, deleting an account, or stopping use of Avira does not necessarily cancel an active subscription. You must cancel through the platform or payment method through which you subscribed. For assistance, contact m4rsl4bs@gmail.com.
9. Acceptable Use
You may use Avira only for lawful, personal, and non-commercial purposes. You must not:
- Violate applicable law, regulation, platform rules, or another person's rights
- Exploit, harm, sexualize, or endanger minors, or create content involving minors in a sexual context
- Submit unlawful, threatening, hateful, harassing, defamatory, exploitative, or infringing content
- Impersonate another person or use the Service for fraud, deception, stalking, or harassment
- Attempt to bypass safety systems or account, age, payment, or access restrictions
- Scrape, crawl, use bots against, overload, disrupt, reverse-engineer, or gain unauthorized access to the Service
- Copy, resell, redistribute, or commercially exploit the Service or its content without permission
- Upload malware or otherwise compromise the security or operation of the Service
We may remove content or restrict access when we reasonably believe it violates these Terms or creates a safety, security, legal, or platform-compliance risk.
10. User Content
You retain any rights you hold in content you submit. You are responsible for that content and must have the rights and permissions needed to submit it.
You grant MarsLabs a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, process, modify, and display your content only as reasonably necessary to operate, secure, moderate, support, and improve the Service. This license ends when the content is deleted from active systems, subject to reasonable backup, legal, and safety-retention requirements.
11. Intellectual Property
The Avira name, branding, characters, design, interface, software, and original materials are owned by or licensed to MarsLabs and are protected by applicable intellectual-property laws. Except for the limited right to use the Service under these Terms, no rights are transferred to you.
12. Copyright and Rights Complaints
If you believe content available through Avira infringes your copyright or other rights, email m4rsl4bs@gmail.com with your contact information, a description of the protected work, the location of the disputed content, evidence of ownership or authorization, and a good-faith statement explaining the issue.
We may remove or restrict disputed content while reviewing a complaint.
13. Third-Party Services and Links
Avira may rely on or link to AI providers, payment processors, analytics tools, authentication providers, app stores, hosting services, and external websites. We do not control third-party services, and your use of them may be governed by their own terms and privacy policies.
14. Availability and Changes
We may update, improve, suspend, restrict, or discontinue all or part of Avira. We do not guarantee that the Service will always be available, uninterrupted, error-free, secure, or compatible with every device.
15. Suspension and Termination
We may suspend or terminate access if you violate these Terms, misuse the Service, fail to pay applicable charges, create risk for Avira or others, or if action is required by law or a platform provider.
You may stop using Avira at any time. Provisions that by their nature should survive termination—including payment obligations, intellectual property, disclaimers, liability limitations, and dispute provisions—will continue to apply.
16. Disclaimer
To the extent permitted by law, the Service is provided on an "as is" and "as available" basis. We do not warrant that generated responses or other content will be accurate, complete, appropriate, uninterrupted, or suitable for your needs.
Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
17. Limitation of Liability
To the maximum extent permitted by applicable law, MarsLabs will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or opportunities arising from your use of or inability to use the Service.
To the maximum extent permitted by law, MarsLabs' total liability for claims related to the Service will not exceed the amount you paid for the Service during the three months immediately before the event giving rise to the claim. This limitation does not apply where liability cannot legally be limited.
18. Indemnity
To the extent permitted by law, you agree to indemnify and hold MarsLabs harmless from claims, losses, liabilities, damages, and reasonable costs arising from your unlawful misuse of the Service, violation of these Terms, or infringement of another person's rights.
19. Privacy
Our Privacy Policy explains how we collect, use, share, and protect personal information when you use Avira and forms part of your relationship with us.
20. Governing Law and Disputes
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Before beginning formal proceedings, you agree to contact us and attempt to resolve the dispute informally. Any dispute that cannot be resolved informally will be handled by the courts having competent jurisdiction under applicable law.
Nothing in this section limits any consumer right or remedy that cannot legally be waived.
21. Changes to These Terms
We may update these Terms from time to time. We will post the updated version on this page and revise the "Last updated" date. Where required, we will provide additional notice. Continued use after updated Terms take effect constitutes acceptance of those Terms.
